1. Limited Warranty

Blue Streak Marketing LLC d/b/a H2Vantix (“H2Vantix”) warrants to the original commercial purchaser that the covered H2Vantix equipment will be free from defects in materials and workmanship under normal commercial use and when operated, maintained, and serviced in accordance with H2Vantix instructions, for a period of three (3) years.

 

This is a limited parts warranty. Except where required by applicable law or expressly agreed in writing by H2Vantix, labor, diagnostic time, travel, on-site service, shipping, removal, installation, packaging, and transportation costs are not included in the warranty.

 

2. Warranty Period

The warranty period begins on the date shown on the original purchaser’s valid invoice, sales agreement, or electronic order. If the documented delivery date is later than the purchase date, the later documented date will control. Replacement or repaired parts do not restart or extend the original three-year warranty period, except as required by law.

 

3. Equipment and Parts Covered

Subject to the terms, conditions, and exclusions in this Policy, H2Vantix will repair or replace, at its option, a covered component that H2Vantix determines has failed because of a defect in materials or workmanship during the warranty period. Covered components may include, when factory-installed and determined by H2Vantix to be defective:

  • PEM/SPE electrolysis cell and associated electrode assembly;
  • Main control board and factory-installed electronic control components;
  • Factory-installed medical-grade power supply and internal electrical components;
  • Water tank and internal water-path components, including factory-installed UV components where applicable;
  • Internal pumps, sensors, valves, displays, cooling components, and other factory-installed functional parts; and
  • Other original internal components supplied by H2Vantix that fail due to a covered manufacturing or material defect.

H2Vantix may use new, refurbished, remanufactured, or functionally equivalent replacement parts, provided they are suitable for the covered equipment.

 

4. Conditions of Warranty Coverage

Warranty coverage is conditioned upon all of the following:

  • The equipment was purchased directly from H2Vantix or an authorized H2Vantix distributor or reseller.
  • The equipment is used for its intended commercial wellness purpose and in accordance with H2Vantix operating, safety, maintenance, and cleaning instructions.
  • Only distilled water or other water expressly approved by H2Vantix is used in the machine.
  • The equipment is operated with adequate ventilation and within the electrical and environmental specifications supplied by H2Vantix.
  • Routine maintenance, cleaning, drainage, inspection, and consumable replacement are performed as instructed.
  • No unauthorized person has opened, altered, modified, rewired, repaired, bypassed, or tampered with the equipment or its safety features.
  • The purchaser provides reasonable proof of purchase, model and serial number, and requested troubleshooting information.

 

5. Items and Conditions Not Covered

This warranty does not cover damage, failure, deterioration, or expense arising from or related to:

  • Misuse, abuse, neglect, accident, improper storage, improper installation, improper operation, or use contrary to H2Vantix instructions;
  • use of tap water, mineral water, alkaline water, contaminated water, additives, chemicals, cleaning agents, or any liquid not approved by H2Vantix;
  • Mineral scale, sediment, corrosion, contamination, water-quality damage, or failure to perform required maintenance;
  • Unauthorized repair, modification, disassembly, alteration, component substitution, software or firmware modification, or tampering;
  • Physical damage, dropping, impact, liquid intrusion outside intended water pathways, fire, flood, lightning, power surge, voltage irregularity, inadequate grounding, or other external cause;
  • Use in an unsuitable environment, including excessive heat, humidity, dust, poor ventilation, or proximity to ignition sources;
  • Normal wear and tear, cosmetic damage, scratches, discoloration, ordinary aging, or changes that do not affect machine function;
  • Consumable or maintenance items, including cannulas, tubing, external connectors, filters, water, seals, jars, drainage accessories, and similar items unless a defect existed at delivery;
  • damage occurring during shipping or relocation after initial delivery unless the shipment was arranged and controlled by H2Vantix;
  • Commercial downtime, lost revenue, lost profits, replacement-equipment costs, staff time, or other indirect or consequential losses; or
  • Use of the equipment for any unlawful purpose or any medical purpose, representation, or application not authorized by H2Vantix.

 

6. Warranty Claim Procedure

Before returning any equipment or component, the purchaser must contact H2Vantix for technical support and obtain authorization. H2Vantix may first require remote troubleshooting, photographs, video, operating logs, serial-number verification, water-use information, maintenance records, or other reasonable information necessary to evaluate the claim.

 

No equipment or component should be shipped to H2Vantix without prior authorization and shipping instructions. Unauthorized returns may be refused or returned at the sender’s expense.

 

If H2Vantix confirms a covered defect, H2Vantix will determine the appropriate remedy, which may include shipment of a replacement part, depot repair, exchange of a component, or another commercially reasonable repair solution. The purchaser is responsible for labor and service charges unless H2Vantix specifically agrees otherwise in writing.

 

7. Service Charges and Non-Warranty Service

Unless a different amount is stated in a written service agreement signed by H2Vantix, standard service charges are:

  • $150 service-call charge;
  • $95 per hour for labor; and
  • Applicable shipping, packaging, travel, replacement parts not covered by warranty, and taxes.

H2Vantix may provide lifetime technical support by telephone, video, email, or other remote methods at its discretion. “Lifetime technical support” does not mean lifetime free parts, labor, on-site service, shipping, or repair.

 

8. Repair and Replacement

H2Vantix will determine whether a covered part will be repaired or replaced. A defective part may be required to be returned to H2Vantix. Unless otherwise agreed, title to a replaced defective part transfers to H2Vantix upon replacement. If inspection shows that the claimed failure is not covered by warranty, the purchaser may be responsible for diagnostic, return-shipping, labor, and repair charges.

 

9. Purchaser Responsibilities

The purchaser is responsible for routine maintenance and safe operation of the equipment, including staff training, use of approved water, maintaining a clean and properly ventilated environment, following all safety instructions, and immediately discontinuing use if the machine appears damaged, operates abnormally, leaks, overheats, produces unusual odor or noise, or displays a warning condition.

 

10. Commercial Use; No Medical Warranty

H2Vantix commercial hydrogen inhalation systems are sold subject to the product’s applicable labeling, regulatory status, instructions, and intended use. This warranty covers the physical equipment only. H2Vantix does not warrant or guarantee any particular health, medical, therapeutic, clinical, financial, revenue, patient, or business outcome from use of the equipment.

 

11. Limitation of Remedies and Damages

To the fullest extent permitted by applicable law, the remedies stated in this Policy are the purchaser’s exclusive remedies for breach of this limited warranty. H2Vantix will not be liable for incidental, indirect, special, exemplary, punitive, or consequential damages, including lost profits, lost revenue, business interruption, loss of use, substitute-equipment costs, or loss of data, arising from the equipment or this warranty, even if advised of the possibility of such damages.

 

To the fullest extent permitted by applicable law, H2Vantix’s aggregate liability arising out of a covered warranty claim will not exceed the amount actually paid to H2Vantix for the specific equipment giving rise to the claim. Some jurisdictions do not allow certain limitations or exclusions, so portions of this section may not apply where prohibited by law.

 

12. Disclaimer of Other Warranties

EXCEPT FOR THE EXPRESS LIMITED WARRANTY SET FORTH IN THIS POLICY, AND TO THE FULLEST EXTENT PERMITTED BY LAW, H2VANTIX DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ANY IMPLIED WARRANTY THAT CANNOT LEGALLY BE DISCLAIMED IS LIMITED TO THE SHORTEST PERIOD PERMITTED BY APPLICABLE LAW.

 

13. Transferability

This limited warranty is issued to the original commercial purchaser and is not transferable to a subsequent owner unless H2Vantix expressly approves the transfer in writing. Any approved transfer may be subject to inspection, registration, transfer fees, or other reasonable conditions established by H2Vantix.

 

14. Governing Law and Venue

To the extent permitted by applicable law, this Policy and any dispute arising from it will be governed by the laws of the State of Florida, without regard to conflict-of-law principles. Venue for any action arising from this Policy will lie in the state or federal courts having jurisdiction in Collier County, Florida, unless another venue is required by applicable law or a separate signed agreement controls.

 

15. Relationship to Other Agreements

If the purchaser has a separate signed purchase, financing, placement, service, or maintenance agreement with H2Vantix, that agreement remains in effect. If there is a direct conflict between this Policy and a later written agreement signed by H2Vantix, the later signed agreement controls to the extent of the conflict.

 

16. Severability and No Waiver

If any provision of this Policy is held invalid or unenforceable, the remaining provisions will remain in full force to the maximum extent permitted by law. A waiver by H2Vantix of any provision or breach on one occasion will not constitute a waiver on any other occasion.

 

17. Warranty Service Contact

Please have the purchaser name, machine model, serial number, purchase date, description of the issue, and any requested photographs or videos available.

 

18. Acknowledgment

By purchasing, accepting delivery of, or using the covered equipment, the purchaser acknowledges receipt of this Commercial Limited Warranty & Service Policy and agrees that warranty service is subject to the terms stated herein, except to the extent prohibited by applicable law or modified by a separate written agreement signed by H2Vantix.
